Policy Statement

Drones iVue is committed to supporting the use of its technologies in legal, responsible, ethical, and respectful ways, as well as to appropriate transparency, privacy, and accountability. All Drones iVue Colleagues are required to know and comply with all laws and regulations applicable to their activities, as well as to the letter and spirit of this Policy, including its attached Information Privacy and Security Policy Notice.


Policy Purpose

The purpose of this policy is to provide Drones iVue's requirements for the operation and use of its technologies. Nothing in this Policy shall be construed to replace or take precedence over the requirements of any local, state, or federal law or regulation.


Scope

This Policy applies to all Drones iVue Colleagues, including its employees, contractors, and agents.


Definitions

  • Colleagues – all Drones iVue employees, contractors, and agents.
  • Consent – words or conduct indicating informed permission. Consent may be expressed or implied, depending on the context.
  • Covered Data – information collected by Drones iVue technologies that identify particular individuals. If data collected do not contain personally identifiable information, or if the data are altered so that specific persons are not identifiable, it is not Covered Data.
  • Data Subjects – means the individuals whose Covered Data are intentionally or unintentionally collected using Drones iVue technologies. "Privacy Policy Notice" means a written notice of Drones iVue's Privacy Policy, consistent with the Privacy Policy Notice attached to this Policy and marked as Attachment A, including information on: (1) the purposes for which Colleagues will collect Covered Data; (2) the kinds of Covered Data Colleagues will collect; (3) information regarding Drones iVue's data retention and de-identification practices; (4) examples of the types of any entities with whom Covered Data will be shared; (5) information on how to submit privacy and security complaints or concerns; and (6) information describing practices in responding to law enforcement requests.

Policy

Inform Potential Data Subjects of the Use of Drones iVue Technologies

Colleagues are required to make reasonable efforts to provide timely prior notice to potential Data Subjects … no later than the time of the collection of the Covered Data.

Use Care when Utilizing Drones iVue Technologies

In the absence of a compelling need to do otherwise or Consent of the Data Subjects, Colleagues are required to avoid using Drones iVue's technologies …

  • to collect Covered Data where Data Subjects have reasonable expectations of privacy
  • for persistent and continuous collection of Covered Data about individuals
  • over or within private property without appropriate notice and Consent

Colleagues are required to avoid retaining Covered Data longer than reasonably necessary …

Limit the Use and Sharing of Covered Data

Colleagues are prohibited from using Covered Data for the following purposes without the Data Subjects' Consent:

  • employment eligibility, promotion, or retention
  • credit eligibility
  • health-care treatment eligibility

Colleagues are prohibited from publicly disclosing Covered Data where disclosure is not necessary to fulfill the purpose for which the technologies were utilized without either:

  • De-identifying the data to the point where it is no longer Covered Data; or
  • Obtaining the written Consent of every Data Subject in the disclosure.

Colleagues are prohibited from using or sharing Covered Data for marketing purposes without

  • De-identifying the data to the point where it is no longer Covered Data; or
  • Obtaining the written Consent of every Data Subject in the disclosure.

There is no restriction on the use or sharing of aggregated Covered Data as an input (e.g, statistical information) for broader marketing campaigns.

  • Participate in and Comply with Drons iVue's requirements to Secure all Covered Data

Colleagues are required to consistently take measures, consistent with Drones iVue's policies, procedures and practices, to minimize security risks of Covered Data. In this regard, Drones iVue will:

  • Maintain, manage and enforce this written Information Privacy and Security Policy, PS-001
  • Make reasonable efforts to regularly monitor our systems for breaches and data security risks
  • Make reasonable efforts to provide security training to our Colleagues who collect, transmit, or otherwise have access to Covered Data
  • Make reasonable efforts to permit only authorized individuals to access Covered Data e.g, Keep this Information Privacy and Security Policy PS-001 ,and the attached information Privacy and Security Notice, up to date and in compliance with applicable laws.

The Information Drones iVue Collects

Drones iVue may collect information about you directly from you, from third parties, and automatically through your use of our products and services. Some information we collect from you is referred to as “Personal Information” or “Personal Data” in this Notice. Personal Information or Personal Data is data that can identify you, or data that we can relate to you, such as your name, email address, credit card number, and shipping address.

  • Account information. When you contract with Drones iVue, you may provide us with Personal Information that includes your user ID, email address or phone number, password or other information for account verification. You might choose to provide us with additional information — like gender, birthday, professional information and other similar information
  • Contact information. When you engage with Drones iVue you may provide us with your contact information, including your name, alias, email address, shipping address, billing address and phone number(s). Certain jurisdictions require provision of contact information when activating robotic and electronic products, opening online accounts, or under other similar circumstances as required by law, and we may ask for such information that is required for compliance purposes.
  • Payment information. When you engage in financial transactions with Drones iVue you may provide us with your payment information such as your bank account, credit card number, or debit card number
  • Photos and Videos. Drones iVue only collects your photo or video with your consent and affirmative actions. When you choose to use Drones iVue products and services, including text content relating thereto, we may collect and store such content, including EXIF data relating to the photo or video. If such content contains information about others, you are required to obtain any required or appropriate Consent from such persons and inform them about this Notice.
  • Communications. When you contact us, we may collect information about your communications with us, including your contact information, and the time, topic, and content of your communications
  • Location information. When you engage with us, we may obtain your geolocation information. You may be required to enable certain features of your mobile phone (such as GPS, Wi-Fi, and Bluetooth), which enable us to identify your location through a variety of means, including GPS location, IP address, cell tower location, geofencing technology, or detection by physical onlocation Wi-Fi or Bluetooth sensors. If your location is collected through Wi-Fi or Bluetooth sensors of your mobile device or other non-Drones iVue products or services, please be aware that such sensors, and the associated data services, may be provided by a third party, which may access such information for the purpose of providing such data services to Drones iVue.
  • Technical Information. When you visit our webpage or use our mobile applications, you may provide us with technical information about the device running the browser or the application. Such information includes your IP address or device address, web browser and/or device type, the web pages or sites that you visit just before or just after you use a product or service, hardware version, and operating system. We also may use these technologies to collect information regarding your interaction with email messages, such as whether you opened, clicked on, or forwarded a message.
  • Employees and Contractors. When you apply for a position with Drones iVue, you may provide us with your educational information, such as your academic degree and graduated school, and employment-related information, such as your former employers and working achievements. We may also collect such information from third party recruiters or websites.
  • Cookies. We use cookies and other similar technologies (e.g. pixels etc.) on our website and online services. Cookies are used to collect information, including Personal Data, from you. Cookies are small files which, when placed on your device, enable us to provide certain features and functionality. To learn more about cookies please see our Cookies Policy (below).

How We Use the Information We Collect

We use information we collect in a variety of ways when providing Drones iVue products and services and operating our business. The use of information that we collect includes the following:

  • To operate and provide features of the Drones iVue products and services, to verify and manage accounts, to provide services and information that you request, and to process and deliver entries and rewards in connection with promotions that may be offered from time to time. We will process your Personal Data in accordance with this Notice.
  • To maintain and enhance Drones iVue products and services, to personalize the content you receive, and provide you with tailored content that may be of interest to you
  • To understand and analyze trends and preferences, to improve the Drones iVue products and services, and to develop new products, services, features, and functionality.
  • To contact you for administrative and informational purposes, including for customer service. We may send direct marketing such as communications, including updates on promotions and events, relating to products and services offered by us and by third parties we work with. If you are an individual, we will only send you direct marketing with your consent or as permitted by applicable law. You may send unsubscribe requests or withdraw your consent at any time.
  • For any other purposes disclosed to you at the time we collect your information or pursuant to your consent.
  • We will aggregate Personal Data we collect, such as the number and frequency of your visits to our sites and apps, to produce metrics and statistical information. We use aggregate data to help us understand how the site is being used and to improve its usability. We also use it to enhance the quality and availability of products and services we offer.
  • To comply with applicable laws, such as laws related to the use of unmanned aerial system technologies.

If you are located in the European Economic Area (“EEA”) we will only use your information when we have a valid legal ground, including when:

  • You have consented to the use of your information. For example, to send you marketing communications.
  • We need to use your information to enter into or perform a contract with you. For example, to deliver Drones iVue products and services, to provide map services, or provide you with the customer support and other services
  • We need to use your information to comply with a legal obligation. For example, to comply with a court order, subpoena, or warrant.
  • We or a third party have a legitimate interest in using your information. In particular, we have a legitimate interest in using your information to understand and improve our products and services, and to monitor for and prevent fraud. We only rely on our own or a third party’s legitimate interests to process your information when these interests are not overridden by your rights and interests.

When We Disclose Information

We will not disclose your information to third parties except as described in this Notice, or as we disclose to you at the time the information is collected. We may disclose information to third parties in the following circumstances:

  • We may share your information with our affiliates and subsidiaries when permitted by law, and as necessary to provide you with our products and services
  • Any information that you voluntarily choose to make publicly available by uploading it to a publicly accessible site or venue, or that you otherwise elect to make public, will be available to anyone who has access to that content, including other users.
  • We may work with third party service providers who provide payment facilitation, application development, traffic monitoring or analysis, electronic messaging, and other services for us. We require these service providers to use or disclose the information they process on our behalf only as necessary to perform services on our behalf or comply with legal requirements.
  • According to local laws and regulations, your location information may be transmitted to and received by individuals, companies, or organizations determined by aviation regulations to be appropriate receivers of such information. Please refer to your local authorities for more information regarding what types of information are subject to these requirements. Your location may be locally broadcast to promote flight safety near critical infrastructure, airports, special events, or to support the activities of law enforcement and security agencies.
  • We may preserve and disclose your information if required to do so by law or in the good-faith belief that such action is necessary to comply with applicable law, in response to a court order, judicial or other government subpoena, warrant or enforceable request.
  • We reserve the right to preserve and disclose your information that we believe, in good faith, is appropriate or necessary to: (i) take precautions against liability; (ii) protect ourselves or others from fraudulent, abusive, or unlawful uses or activities; (iii) investigate and defend ourselves against any third-party claims or allegations; (iv) protect the security or integrity of our products and services, and any facilities or equipment used for our products and services; and (v) protect our property or other legal rights (including, but not limited to, enforcement of our agreements), or the rights, property, or safety of others
  • Information about our users, including information you provided and any information collected through our products and services, may be disclosed and otherwise communicated to an acquirer, successor, or assignee as part of any merger, acquisition, debt financing, sale of assets, or similar transaction, or in the event of an insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets.
  • We may make certain aggregated, de-identified, or non-identifying information about users of our products and services available to third parties for various purposes, including: (i) compliance with various reporting obligations; (ii) for business or marketing purposes; (iii) product safety analysis; or (iv) to assist such parties in understanding our users’ interests, habits, and usage patterns for certain programs, content, services, advertisements, promotions, and/or functionality of our products and services.

Your Rights and Choices Regarding Collected Information

You may update, correct, or delete certain account information and preferences. If you receive commercial email or text messages from us, you may unsubscribe at any time by following the instructions contained within the email or text message. You may also opt out from receiving commercial email or text messages from us by sending your request to us at privacypolicy@dronesivue.com

If you are located in the EEA, you may also have the right to request access to additional information, including the right to:

  • request access to and receive certain information we maintain about you
  • update or correct inaccuracies in the information we maintain about you
  • receive a copy of the information which you provided for its transmission to another company
  • object to the processing on grounds relating to your particular situation
  • have the information blocked, deleted, or erased, as appropriate

When we process Personal Data on the basis of your consent, you can also withdraw your consent. If you withdraw your consent, we will apply your preferences going forward, and this will not affect the lawfulness of the processing before you withdraw your consent. Note, however, that if you exercise your right to object or your rights of blocking, deletion or to be “forgotten,” or if you decline to share certain information with us, or if you withdraw your consent to our processing of information about you, we may not be able to provide to you some, or any, of our products or services.

Please note that while any changes you make will be reflected in active user databases within a reasonable period of time, we may retain all information you submit, as authorized under applicable law, for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so. In addition, if certain information has already been provided to third parties as described in this Notice, retention of that information will be subject to those third parties' policies. Third-Party Services

Drones iVue's products and services may contain features or links to websites and services provided by third parties. Any information you provide on third-party sites or services, or any information otherwise collected by such third-party sites or services is collected directly by the operators of such services and is subject to those operators' policies, if any, governing privacy and security, even if accessed through Drones iVue's products and services. You agree that we are not responsible for the content or privacy and security practices and policies of thirdparty sites or services to which links or access are provided through Drones iVue’s products and services. Please be sure to check the privacy policies of these sites, as well as their terms and conditions before engaging in any business or uploading any information.


Children's Privacy

Drones iVue's products and services are not directed to children under the age of 16. We do not knowingly collect information from children under the age of 16 without obtaining parental consent.


Data Security

We use certain physical, organizational, and technical safeguards that are designed to improve the integrity and security of information that we collect and maintain. Please be aware that no security measures are perfect or impenetrable and thus we cannot and do not guarantee that your information will not be accessed, viewed, disclosed, altered, or destroyed by breach of any of our physical, technical, or organizational safeguards.


International Transfers of Personal Data

Your information collected by Drones iVue may be transferred to and accessed by Drones iVue entities and business partners globally. You should be aware that the local laws in non-EEA countries may provide less protection than the laws applicable in the EEA. We nonetheless provide the same level of protection as specified in this Notice, regardless of the location of processing. For international transfer of data collected in the EEA, we require data recipients to enter into the model contractual clauses approved by the European Commission, or to be certified under the EU-US Privacy Shield. Changes and Updates to this Notice

We may update this Notice from time to time. If we modify this Notice, we will make it available on or through our website, indicating the date of the latest revision. We will make reasonable efforts to notify you of the changes.

California Privacy Notice

This California Privacy Notice supplements the information and disclosures contained in Drones iVue's Notice. It applies to the Personal Information of certain California residents, who are Consumers receiving products or services for which we are a Business, as those terms are defined under the California Consumer Privacy Act of 2018 (California Civil Code §§ 1798.100 to 1798.199) and its implementing regulations, as amended or superseded from time to time (“CCPA”).

Briefly, and as more fully defined in the CCPA, Personal Information means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular Consumer or Household; however, certain categories of information may be excluded, including, for example, de-identified or aggregate information, information lawfully made available from government records, medical information, data subject to HIPAA, data maintained by healthcare providers in the same manner as data subject to HIPAA, clinical trial data, consumer credit reporting agency data or data subject to the Fair Credit Reporting Act, data subject to the Gramm-Leach-Bliley Act, data subject to the Driver's Privacy Protection Act, and data relating to vehicle ownership or warranty information.

Any capitalized terms herein are intended to have the same meaning as in the CCPA.


California Consumers' Rights and Choices

If you are a Consumer, California law may permit you to request information regarding the:

  • Categories of Personal Information (as defined by applicable California law) collected, sold or disclosed by us
  • Purposes for which categories of Personal Information collected by us are used
  • Sources of information from which we collect Personal Information
  • Specific pieces of Personal Information we have collected about you

In addition, if you are a Consumer you may:

  • Opt-out of the sale or disclosure of your Personal Information, in some circumstances
  • Opt-out of the sale or disclosure of your Personal Information, in some circumstances
  • Opt-in to certain financial incentive programs we may offer related to the collection, sale, or deletion of your Personal Information

  • Auditing related to a current interaction with the consumer and concurrent transactions, including, but not limited to, counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with this specification and other standards
  • Detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity
  • Debugging to identify and repair errors that impair existing intended functionality
  • Short-term, transient use, provided that the Personal Information is not disclosed to another third party and is not used to build a profile about a consumer or otherwise alter an individual consumer’s experience outside the current interaction, including, but not limited to, the contextual customization of ads shown as part of the same interaction
  • Performing services on behalf of the business or service provider, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing advertising or marketing services, providing analytic services, or providing similar services on behalf of the business or service provider
  • Undertaking internal research for technological development and demonstration
  • Undertaking activities to verify or maintain the quality or safety of a service or device that is owned, manufactured, manufactured for, or controlled by the business, and to improve, upgrade, or enhance the service or device that is owned, manufactured, manufactured for, or controlled by the business.

We will review the information provided and may request additional information to ensure we are interacting with the correct individual. If you have an online account with us, you may be required to log in for identity verification. If you do not have an account, additional information may be required by law before we can act on a request.

By law, we are not required to collect Personal Information that we would not normally collect, retain it longer than usual, or re-identify de-identified information. If we have not specifically requested additional information, please do not send it.
